Animal welfare takes priority in separation

Düsseldorf. In the event of a divorce, the allocation of the family dog depends on who the animal's main caregiver is and who can best look after the animal after the separation. It is not a punishment for misbehavior, in this specific case the affair with another woman.

According to ARAG experts, this is exactly what the cheated wife wanted to achieve: when she left her unfaithful husband, she took their dog with her without telling her ex where he was. The case ended up in court. But the judges at the Marburg District Court were also convinced that the husband was the better match from the dog's point of view. After the separation, he lived in a house with a garden in the dog's old and therefore much more species-appropriate environment. The wife had to be satisfied with visitation rights with the dog.
