ARAG experts explain court rulings relating to dogs

Dispute over Pomeranian 'Bella':
Borrowed dog can stay in new home
Due to a high-risk pregnancy, the owner of the Pomeranian 'Bella' was no longer able to care for her animal. A close friend agreed to initially take the dog in on a trial basis. 'Bella' then moved – along with her dog and vaccination certificate. The pregnant woman only kept the breeding papers as a precaution. The probationary period ultimately turned into two years during which the two women maintained less and less contact. During this time, the friend registered the dog as her own, paid the dog tax and covered all running costs. When the original owner asked for her dog back, the interim owner no longer wanted to give the dog back. The case ended up in court. According to ARAG experts, the judges decided that Pomeranian 'Bella' was allowed to stay in her second home after two years of comprehensive care (Hamm Higher Regional Court, Ref.: 6 S 117/25).

Are dogs allowed to bark longer in the country?
Barking dogs can be the breaking point for any good neighborhood. And courts regularly deal with this issue. One thing is clear: a dog cannot be silenced like a telephone. However, owners must train their animals so that they do not bark around the clock. Especially in apartment buildings, four-legged friends also have to adhere to rest periods. However, the ARAG experts point out that things can look different in rural areas. If the dog lives in a rural area, neighbors may have to tolerate the dog's barking, even at night and on Sundays and public holidays. In a specific case, an owner of three livestock guard dogs, which she kept outdoors as guard dogs, successfully defended herself against the complaints of her neighbors. These required rest times to be observed from 10 p.m. to 6 a.m. and on Sundays and public holidays between 1 p.m. and 4 p.m. During this time she didn't want to hear any noise from the three neighboring dogs. But the judges had a heart for animals and decided: A short-term, occasional and isolated attack by the guard dogs in this rural location was normal and therefore acceptable (Higher Administrative Court of Mecklenburg-Western Pomerania, Ref.: 1 M 495/21).
