Dusseldorf. An off-leash Chihuahua frightened a heavily pregnant woman so much that she ran away, fell and injured herself. The woman demanded compensation in court. While, according to ARAG experts, the Ansbach regional court in the first instance found her to be partly to blame, the Nuremberg Higher Regional Court, on the other hand, was of the opinion that the dog owner had violated the obligation to be kept on a leash and was therefore liable for damages. Damage resulting from understandable avoidance or escape behavior can be attributed to the owner (OLG Nuremberg, Ref.: 13 U 1961/24).
